Erika Jayne from The Real Housewives of Beverly Hills was given a stay of execution, metaphorically speaking, as news spread that she had been dismissed from the ongoing fraud and embezzlement lawsuits against her ex-husband, Tom Girardi. While a judge may have dismissed the case, it doesn't mean that she is in the clear.

After Tom was accused of embezzling money meant for the victims of Lion Air Flight 610, Erika and the disgraced lawyer have been at the center of multiple court battles. The allegations are serious and a lot of people have questions. Due to these allegations, the "Pretty Mess" singer has been at odds with nearly every other Beverly Hills housewife, as well as many fans of the series. Back in October, Tom dropped a bombshell, implying that Erika knew about his misdeeds and chose to ignore them while chatting to the paparazzi. Erika was also slapped with a lawsuit after lawyers found that the Girardi & Keese law firm sent money to Erika's LLC, EJ Global, and paid for her opulent lifestyle from 2008 to 2020.

After the news about Erika's dismissal broke, many RHOBH fans were elated. However, the fact that a judge dismissed the charges doesn't mean that the "Roller Coaster" singer is in the clear. In a statement released by the court, the judge said that the charges were dismissed against Erika without prejudice (and without costs) after a January 29 hearing. Still, Jay Elderman, who is the original lawyer to file charges against Tom, noted that the fight was far from over. In fact, the legal team plans to file charges in California to avoid jurisdiction issues.

The plaintiff's attorney made it clear that RHOBH's Erika wouldn't be let off the hook, especially with the mountain of evidence he claimed to have. As most fans of RHOBH know, Erika filed for divorce back in November of 2020, right before she and Tom were blitzed with multiple lawsuits. The opposing counsel questioned whether the divorce was a sham and a ploy to distance herself from Tom's legal issues. The case has been confusing to some, especially after a judge ordered Tom and his firm Girardi Keese to file for Chapter 7 bankruptcy in January of 2021. Only a few months later, Tom was suspended from practicing law by California federal courts.

Since July, Erika has been fighting a ruling which stated that her estranged husband's clients could attempt to collect money owed from her. The verdict came after it was cited that Tom's law firm had given Erika nearly $20 million and had it transferred to her LLC, EJ Global. While it may feel like good news to Erika that her case was dismissed, she is, in fact, a long way away from clearing her name. The Real Housewives of Beverly Hills season 12 is currently filming, and the drama has not stopped since the cameras have been following the case in real-time.
