Tom Girardi, formerly acclaimed lawyer and ex-husband to The Real Housewives of Beverly Hills star Erika Jayne, had yet another major loss when his case for bankruptcy discharge was denied in court. Ever since allegations of Tom's millions of dollars in embezzlement first emerged, the class action veteran has taken a downward spiral, with his younger brother subsequently taking the role of his conservator. The scandal soon grew to become a key storyline in the latest season of RHOBH, with everyone wondering exactly how much Erika knew about what was going on.

Tom's current legal issues first made headlines when he was sued for his alleged misappropriation of $2 million in funds that were intended for the victims impacted by the 2018 Lion Air plane crash. Once news of Tom's legal problems and possible wrongdoings spilled over into RHOBH season 11, fans witnessed Erika trying to cope with her failing marriage and nonstop questioning of her involvement in the scandal. Tom's law firm was soon forced to file for bankruptcy and even took to auctioning off various items from its office. Fresh off the heels of losing his license to practice law, Tom was reportedly diagnosed with Alzheimer's disease on March 11, 2021.

Due to the scarcity of his records, Tom's appeal for bankruptcy discharge was denied in court. Based on documents acquired by Radar Online, the records Tom provided failed to provide any information for the court to properly validate enough past transactions of the state or his current financial state. The court's decision was influenced by the large amounts of money that should be within Tom's possession that are now gone without a trace.

While many fans (and a select few of her fellow Housewives) have their fingers pointed at Erika for having some sort of involvement in the legal drama, her attorney has gone on record to dispute any allegations or rumors. Evan Borges of Greenberg Gross put out a statement in an effort to clear Erika from any connection to alleged embezzlement: "There’s absolutely no evidence that Erika, an entertainer with no law degree, had anything to do with the decisions and actions of Tom Girardi and [Girardi & Keese] related to the Lion Air settlement money." 

Erika's road towards vindication from this scandal is still quite murky, with little to no clear end in sight. As the legal process continues, only time will tell if the "How Many F--ks" singer will make it out of this scot-free. What is certain is that fans of The Real Housewives of Beverly Hills will continue to follow Erika's legal fight next season, as she has no intentions of ending her time on the show just yet.
