One of the biggest issues in season 11 of Bravo's The Real Housewives of Beverly Hills was Erika Jayne's legal woes with ex-husband Tom Girardi. Now, in season 12, it doesn't seem like these issues have fully been put to bed. One episode in, Erika still seems to be showing signs that she is lying about the lawsuit.

Last season of RHOBH saw its fair share of eyebrow-raising moments from the housewife as she battled a real-life legal scenario and fought the court of public opinion. Millions watched on as Erika faced backlash while news broke of her potential involvement in the embezzlement of settlement funds for victims of Lion Air Flight 610, which crashed and left no survivors in 2018. Articles and information regarding the legal battle surfaced while the ladies were filming RHOBH season 11, and Erika was forced into the spotlight for all the wrong reasons. Many found Erika's responses cold and unsympathetic, particularly when she went head-to-head with cast member Sutton Stracke in an uncomfortable confrontation at Kathy Hilton's house.

In the premiere episode of The Real Housewives of Beverly Hills season 12, Erika and Garcelle work out together, discussing the feud between Erika and Sutton. When Garcelle asks if Erika is going to apologize for threatening Sutton at Kathy's dinner ("You ever call me a liar again, I'm coming for you"), Erika seems unmoved to do so and even needs reminding about what she should be apologizing for. Garcelle's not impressed by Erika's firmness and their conversation takes a turn when Erika assures Garcelle that the things Sutton brought up regarding the lawsuit, including a $20 million deposit into Erika's LLC, have been disproven. In a confessional with Garcelle, it's not hard to tell she's not convinced by Erika. Garcelle wonders why, if it is false, it hasn't been all over the news yet.

Then, a producer can be heard speaking to Erika in her confessional, asking when these accusations were disproven. Erika offers a chilling response, saying, "It was disproven early, so Bravo can do their due diligence". The RHOBH star clearly wants to move on from the situation, while the women are still unsure Erika's involvement in the lawsuit is over. It doesn't seem as though Erika and Garcelle stay friendly for much longer, either. Erika threw Garcelle's new book in the trash and documented it via Instagram video recently, hinting to followers and RHOBH fans that Garcelle hasn't backed down from questioning Erika's situation.

Right from the start of RHOBH season 12, it seems Erika's not backing down as she believes luck is on her side when it comes to the legal woes. A number of social media posts by Erika since the allegations arose show little concern for the situation, and fans have been quick to pick this apart and question her integrity. Plus, as seen in the RHOBH season 12 trailer, things don't end after episode 1, as Erika confronts Crystal for being "on the side of the victims," and Garcelle assures Erika that she's capable of making herself look bad without any help from the other women.
