It seems like the lawsuits and allegations won't stop coming against Erika and Tom Girardi. After The Real Housewives of Beverly Hills stars filed for divorce last November, the two have been hit with an onslaught of legal woes. Now, many fans are wondering if the reality star and her powerhouse attorney husband could be headed to jail.

It was just last week when a lawyer shared tweets showing documents pertaining to Erika and Tom defaulting on their property taxes and facing eviction. The non-paid tax reports came weeks after Tom's assets were frozen due to all the people coming after him with lawsuits. The 81-year-old and the "XXXPen$ive" singer were first hit with a class-action lawsuit over settlement funds that were meant to go toward the families of victims of Lion Air Flight 610. Additionally, Tom has been sued by Wells Fargo for bank fraud and by his former law firm partner Robert Keese for bad business dealings. His own son-in-law threw him under the bus in the $2 million embezzlement case due to his close circle all being at risk. Erika was even forced to stop selling her secondhand clothes online due to the claims. Most recently, the bankrupt attorney said he was mentally incompetent to stand trial and his brother would be his guardian moving forward.

In a recent petition obtained by RealityBlurb, Tom's brother, Robert Girardi, told the bankruptcy judge that Tom "is incompetent and unable to act for himself."  Additionally, Roberts fears his brother is suffering from extreme memory loss and unable to understand how much legal trouble he is in. After achieving fame through the Erin Brockovich case, he is accused of using his Girardi Keese firm to take part in shady business practices. In the petition, Robert claimed his brother was “incapable of realizing and understanding the repercussions of the bankruptcy filings pending against him and his law firm Girardi Keese." He adds that Tom was not comprehending when having it "explained to him over and over and by various people."

With his health failing him, and the lawsuits plaguing him, his brother says Tom is "not capable of making rational decisions with respect to his financial responsibilities." But, that doesn't mean the Girardi's are off the hook. With them still being legally married and Erika being named in the embezzlement lawsuit, the two are still facing some serious charges. All the while, Erika is off filming season 11 of RHOBHShe has said that she will not hold back when opening up about her divorce on screen. However, will she be as forthcoming about the lawsuits? To make matters worse for the reality star, she was accused of criminal activity after she accused a female judge of being Tom's mistress. The judge fired back and threatened legal action against the Bravo star.

If sent to jail, this wouldn't be the first time fans watched a housewife serve time. Teresa Giudice and her husband Joe Giudice were both sent to prison on The Real Housewives of New Jersey. Like Erika and Tom, their charges stemmed from shady financial matters that put them behind bars.
