Tom Girardi from The Real Housewives of Beverly Hills is reportedly suffering from memory loss, according to his brother, Robert. He believes that Tom may require conservatorship. In addition, Tom is allegedly incapable of handling the charges filed against him.

Fans have questioned Erika Jayne and Tom's relationship ever since she joined the reality series back in 2015 for season six. After being on the show for several years and seemingly having a good relationship, fans began to root for Erika and Tom. Now that the couple has filed for divorce and entered some serious legal trouble, their relationship is no longer what fans thought it was.

According to documents obtained by Us Weekly, the 81-year-old's brother, Robert Girardi, claims Tom is currently suffering from short-term memory loss. Robert also claims Tom needs a conservatorship and requested to have control of Tom's finances so he can help the court gain access to his records since the involuntary Chapter 7 bankruptcy case. “[Tom] is incapable of realizing and understanding the repercussions of the bankruptcy filings pending against him and the Debtor,” the documents have revealed. “Furthermore, the TG is not capable of making rational decisions with respect to his or the Debtor’s financial responsibilities.” Robert wants to help Tom in the current legal battle, as he has not been physically and mentally stable enough to fight this battle on his own.

Not only is Tom going through a divorce with his estranged wife, Erika, but the couple has also been accused of faking their break-up in order to protect their fraudulent money. Nonetheless, they have also been accused of embezzling $2 million in settlement funds that were supposed to be given to the families of Lion Air Flight 610 victims in 2018. A couple of months after testifying against the embezzlement case in September 2020, Tom was unable to attend another hearing due to a secret hospitalization. Keith Griffin, a lawyer at Tom's firm, revealed Tom was “unavailable in recent weeks due to a serious illness that caused him to be hospitalized for which he sought treatment.” Another attorney Tom had recently hired, Evan Jenness, admitted to a judge back on December 14 that Tom should undergo a mental examination, claiming Tom does not understand "the nature or the gravity of the current situation.” This led the judge to ultimately freeze their assets and forbade Erika from selling her clothes through the French retailer, Vestiaire. A source has revealed Erika was unaware of Tom's legal woes prior to 2020, finding out through the press just like the rest of the world.

Erika will reportedly address the legal matter in the upcoming season of RHOBH and will not be holding back. She may even bring up Tom's alleged affair. Season 11 is going to be an interesting one.
