Page Six was the first outlet to report that Girardi had been diagnosed with late-onset Alzheimer's disease and dementia. The 81-year-old went through a rigorous mental assessment in February due to his brother Robert being named as his permanent conservator. In a sworn statement obtained by the outlet, Dr. Nathan Lavid wrote that the lawyer was unfit to attend any court proceedings. Dr. Lavid wrote that "dementia impairs his ability to understand the hearing."

The psychiatrist revealed that Girardi's emotional distress was directly related to his dementia and "exacerbated" by his confusion. Girardi struggles with short-term memory and ability to concentrate and has a moderate impairment, but he also suffered from delusions. The doctor also wrote that he suffers from disorganized thoughts and would be no help to himself at a trial. Questions have been raised about the lawyer's health after he was hospitalized in December for an illness.

The legal issues are really piling up for Girardi, and the couple does not have a prenup, not that it matters since it looks like most of his money will go towards his legal fees.
