Lawyers involved in one of the lawsuits against Erika and Tom recently served a subpoena to Bravo producers to obtain unseen RHOBH footage of Erika (via Fox News). Attorney Jay Edelson, who previously worked with Tom Girardi, believes the network has hundreds of hours of footage, along with documentary evidence, that directly relates to the lawsuit he filed against the reality TV star. Edelson said Bravo has chosen to use the scandal of  Tom's embezzlement from disaster victims to increase its ratings and make a profit. "We are hoping that Bravo changes course and decides to stop protecting Erika and its own bottom line and not make a bad decision to impair our investigation and help us recover much needed money for the victims," Edelson said.

Erika attorney, Evan Borges, called the subpoena of Bravo's footage a "fishing expedition" or "desperation move" if it is directed at Erika personally. Erika's lawyer stated there is no "hidden treasure" in the subpoenaed footage and argued they have supported that claim by providing counsel for the bankruptcy trustee with all the financial information related to the case. "There’s only a small amount of additional information that I need to provide to the trustee, which, along with everything else we’ve provided, shows that Erika’s divorce filing was for legitimate reasons, and she has been trying to make it on her own," Erika's attorney said.
