About a month ago I wrote about how the Terminator franchise rights were up for grabs now that the company who owns the rights, Halcyon Co., has filed for bankruptcy. Well, the rights to the beloved sci-fi franchise are now officially on the auction block and we already have a wild opening bid that’s making news.

The man behind the bid? Joss Whedon, creator of Buffy The Vampire Slayer and Dollhouse.

According to the LA Times, The Halcyon Co. hopes to have the Terminator rights sold off by January, 2o1o, if only to start recouping some of the money they lost on the failed venture that was this summer’s Terminator Salvation (that title suddenly holds a lot of irony, doesn’t it?). There is also the possibility that Halcyon will hop on a “stalking horse,” which is basically a motivated buyer who bids early (and high enough) to have the property put on hold while the buyer then performs full due diligence on said property. To boil it even further down into layman’s terms: If some high-pockets out there thinks there is enough juice left to be squeezed out of the Terminator franchise, they’ll pay to be able to look deeper into just how much money they can make off it.

Sony and Warner Bros. are being floated as the studios circling the property right now, as is independent studio Summit Entertainment (the Twilight guys). But studios are not the only ones interested, apparently; rich guys from the private sector “…have expressed strong interest” said Kevin Shultz, senior managing director of FTI, Halcyon’s hired financial advisors. Ironically enough, one of those private sector guys making an early bid is none other than Joss Whedon, who in the last 24 hours posted a whopping $10,000 bid for the Terminator rights on fan site whedonesque.com, sparking off rumors galore.

Since that initial “bombshell,” Whedon has explained his out-of-left-field bid to Entertainment Weekly:

“Here’s the thing: It’s not a slam on The Terminator. I love The Terminator. That part’s totally true. I was thinking to myself, ‘Not since they auctioned off frames from The Little Mermaid have I wished I had more money this much. So you know what, never hurts to ask.’ I loved the movies, even the later movies. I loved the mythology. I loved the TV show [The Sarah Connor Chronicles]–like, really loved. Not for pretend. And not just because of [star] Summer [Glau].”

The most surprising thing I read in that quote is that Joss Whedon is actually a fanboy for The Sarah Connor Chronicles – that show certainly didn’t do any favors for the first season of Whedon’s Dollhouse last year!

Needless to say, I’m sure The Halcyon Co. will get a better offer than Whedon’s for the Terminator rights – but wouldn’t be cool if by some chance Joss Whedon became the master of the Terminator universe (or would that be more of a disaster)? Anyhoo, Halcyon bought the rights for $25 million and now figures their worth – after all the great, great, work they did on Terminator Salvation – to be up around the $60 million range. Whoever nabs said rights gets to call the shots on how any other sequel films or TV spin-offs will go down (hopefully far removed from McG’s terrible plans for T5), and will inherit whatever money can still be squeezed out of Salvation when it hits DVD in December.

Do you have a strategic business plan for who should hold the rights to the Terminator franchise? Should it be a studio or an independent investor who just has that much love for the series?

Somebody over at The Halcyon Co. should’ve been listening when Linda Hamilton’s Sarah Connor told us that the future isn’t certain in Terminator 2. Just a few months ago, a sequel to Terminator Salvation was all but guaranteed; then came the lawsuits between Halcyon (owner of the Terminator franchise rights) and Pacificor, the hedge-fund that sponsored Halcyon’s purchase of the Terminator rights.

Now, it seems that The Halcyon Co. (headed by Derek Anderson and Victor Kubicek) is so far in the red – between Terminator Salvation’s underwhelming returns at the box office, the venture capital needed to buy the franchise rights and alleged manipulations by Pacificor to ensure Halcyon’s financial ruin – that the company is reportedly looking to sell off the Terminator rights to make a buck.

If you want to read details of The Halcyon Co.’s financial quagmire, go here. If you want to know about the convoluted history of the Terminator franchise rights, go here.

When word of this Halcyon/Pacificor legal battle emerged back in August, we here at Screen Rant wondered what kind of effect the legal fallout would have on Terminator 5, which Salvation director McG was already prepping. Now that this new report has surfaced, it seems that Sarah Connor’s prophetic words of “No Fate” are coming to pass; until the rights to the Terminator franchise are secure in SOMEBODY’s hands, whatever time-traveling, future-warring plans there may have been should be considered wiped clean off the slate.

I for one am indifferent about all this: after I heard McG’s plans for Terminator 5 (hint: abandoning the future war storyline and returning to the present), I was like “I could live happily without that film EVER being made.” So, if the franchise rights DO get pushed out into the open market, I just pray that whoever snags them has a better plan in mind than Halcyon and McG did. I was NOT a fan of Terminator Salvation and was fearful that the franchise was well on the way to having whatever past greatness it had strangled out of it.

What do you think of these latest developments in the war over the Terminator franchise? Do you see an opportunity here, or should this franchise put set back on the shelf until (inevitably, if current trends are any indication) it’s time for a remake/reboot of Cameron’s vision?

As if fan reaction and underwhelming box office weren't enough for T4, it looks like Terminator 5 has even more hurdles to overcome.

Just a couple weeks after we reported that McG was prepping Terminator 5, it appears that the film may be dead in the water. According to a number of sources, a proposed sequel to this year’s underwhelming Terminator: Salvation may be out of the question due to a legal dispute between The Halcyon Co. (which own the rights to the Terminator franchise) and Pacificor (a Santa Barbara, California-based hedge fund that helped Halcyon buy the franchise).

As explained in the L.A. Times, The Halcyon Co., which is headed by Derek Anderson and Victor Kubicek, has filed two separate $30M lawsuits against the company (one against Pacificor and one against a former Pacificor employee).

 What’s all the litigation about?

I’m glad you asked, because it’s a little complicated. The lawsuits stem back to April 2007, when Pacificor first issued Halycon a $30M loan to acquire the rights to Terminator. In December of 2007, Pacificor provided an additional $5M bridge loan to Halcyon. This month, Pacificor filed a lien against Dominion Group (a subsidiary of Halcyon, which is also operated by Anderson and Kubicek) for the $5M loan. According to Anderson and Kubicek, however, they don’t owe a penny. According to them, Pacificor filed the lien in a “desperate and deliberate attempt to seize ownership and control of the Halcyon entities and of the ['Terminator'] franchise.”

Juicy stuff, right? The second lawsuit against former Pacificor Vice President Kurt Benjamin is even better. According to that lawsuit, Benjamin committed fraud by knowingly hiding the fact that he was working for Pacificor at the time he was negotiating with Anderson and Kubicek. By not disclosing his relationship with Pacificor, Benjamin was able to negotiate better terms for his company. Anderson and Kubicek also claim in their lawsuit that Benjamin encouraged them to invest in the production of a Terminator Salvation video game which would help ensure that the company “would not be able to meet its obligations and would therefore fall under the total control of Pacificor.” (Not very much faith in the video game, ay?)

The complaint also alleges, among other things, that Benjamin “blackmailed” Halcyon by forcing the company to pay kickbacks to close its various loans, that Pacificor CEO Andrew Mitchell demanded a $250,000 a year salary to serve on Halcyon’s board, and that fellow Salvation producer Moritz Borman intentionally forced the film over budget so the company would default on its loans.

What does this mean for Terminator 5?

Unfortunately (or fortunately, depending on your opinion of Terminator), because of the lien against Dominion Group, Anderson and Kubicek have been unable to borrow money against their $7.5M producer fees for Terminator: Salvation to begin production on Terminator 5. In fact, according to Variety, T. Asset Acquisition (the Halcyon subsidiary which owned the Terminator rights) has filed for Chapter 11 bankruptcy. Because the Chapter 11 filing comes only one day after Halcyon filed its two lawsuits, it seems like a pretty sure sign that the company will not retain the rights to the franchise.

Does this mean there will be no Terminator 5 ever? Of course not! It’s Hollywood, and in Hollywood there’s nothing better than a franchise. It’s impossible to speculate exactly when a Terminator sequel could come out or what it could be about until this litigation is resolved. However, assuming that Pacificor wins the rights to Terminator as collateral for Halcyon’s unpaid loans, there’s no reason to suspect that the company would not try and produce their own film. Even though Terminator: Salvation had a hard time finding an audience, the Terminator franchise still has strong value and it would be foolish for Pacificor to simply let it go to waste.

What do you think? Is there still hope for the Terminator franchise?

Two film directing projects on the horizon for McG (Terminator Salvation) is the Disney remake of 20,000 Leagues Under the Sea, and the fifth installment in the Terminator franchise, currently being referred to as simply Terminator 5. It appears that McG’s focus is currently on 20,000 Leagues, with T5 to follow after that. Thanks to IESB and Collider, we have an update on both high-profile projects.

20,000 Leagues Under the Sea

McG’s film appears to be both a remake of the Richard Fleischer film from 1954 that starred Kirk Douglas and James Mason, as well as a new kind of adaptation of the 1870 novel by Jules Verne. McG has talked about the aim to for his version:

“It’s a bit of a departure from the Fleischer movie, and much more in keeping with the spirit of the novel, as far as what Aronnax is up to, and the becoming of Nemo, and how the man became at war with war itself. So there’s a little bit more meat on the bone in regard to the genesis of the Nemo character than you’re given in the ’50s movie that Disney made. And also, it’s a little more contemporary.”

“I love that [original] movie, but there were two female characters, and they were both prostitutes. And, there were a couple of black people in the film, and they were all electrocuted. So, nowadays, I think we need to progress a little bit beyond that.”

The movie appears to be quite far along in the development stages, since McG reveals they’ve been scouting various shooting locations around the world from France, Japan and England, to Canada, Australia and Hawaii (the latter for some sort of “little volcano work”). McG has revealed he is aiming for it to be an action-packed film, trying to capture the spirit of the adventure from the original story.

.

Terminator 5

Although McG says his focus is very much on 20,000 Leagues at the moment, he reveals that he’s also prepping Terminator 5. With such a complex world to manage in the Terminator franchise, I’d say McG is wise to at least have the next installment in mind, even if it’s still a ways off.

McG talked about his intention for the Terminator franchise, speaking about whether or not he wants to take a break from it or dive back in, as Michael Bay did with Transformers 2. He says he’s excited about the next part of the series’ story, and talks about a possible angle for it that could see it getting, “out of the apocalyptic world and into the contemporary world.”

Hmmm…

One great thing to hear is that McG is listening to what fans have been saying (good and bad) about Terminator Salvation, and reassures us he takes it on board. He admits that when people don’t like something you’ve done, all you can do is look at what you did wrong (and, indeed, what you did right) and try and evolve as a storyteller.

Although I don’t think McG should allow fans to completely shape his vision for the next Terminator, he should pay at least some attention to those who ultimately buy the tickets to see the movies.

I’m very interested to see how 20,000 Leagues will turn out, specifically with McG at the helm. He’s not the director I would have personally picked, nor did I see coming the news about him being chosen for it, but nonetheless it’s an interesting choice.

The part about the next Terminator possibly going from the, “apocalyptic world into the contemporary world,” was first hinted at a few months ago when McG brought up the time travel angle again. An industry source then said that T5 would see the franchise (specifically John Connor) transported back in time to London, England. That, combined with what McG has said above, could mean that rumor could very well turn out to be true.

If this was the case, it would take the franchise away from the future war between man and machine that we’d heard about for the first three movies, and back to the old (no pun) travel-back-in-time formula. Haven’t we been there and done that? Isn’t three movies of that enough? As much as Salvation had problems, one of the aspects I loved was finally getting to see the future war. I just don’t know if it’s right to revert back to the old ways of the franchise.

What do you think about what McG has said: Do you like the direction he’s going with 20,000 Leagues? How about the direction he’s thinking about going with T5?

20,000 Leagues Under the Sea is currently in the development stages and doesn’t have a release date yet. Terminator 5 is in the prep stage and also doesn’t have a release date.

That commercial showed off the fact that Arnold Schwarzenegger’s face appeared in the movie in a short scene as the T-800 killing machine.

Why is that significant?

Well, my thoughts were that the folks behind the movie were getting desperate to have people come see the movie in theaters now that it has been out for several weeks in North America and had not lived up even close to where they expected it to be in terms of box office numbers. What does that mean for its potential sequel?

The film had received mostly negative reviews from critics everywhere, the worst out of the franchise. Its opening weekend was weak, coming second to the Night at the Museum sequel and not even coming close to other May openers such as Star Trek, Wolverine and Pixar’s Up. Since then, it dropped off significantly and it continues to do so with big movies opening weekly during the busy summer season. This is especially bad since they went for the PG-13 rating on the film to open it up to the younger movie-going audiences.

With poor reception and poor numbers, the $200 million production budget no longer seems like a good investment. Worse, the franchise is no longer as strong as once thought. Is it the brand name that’s not selling as much? Or could it be that Terminator needs the Governator as the lead?

McG’s Terminator Salvation was supposed to be one of the biggest movies of the year and more than that, it was supposed to be the start of a whole new trilogy of films. Leading up to the release of this fourth installment, there was plenty of talk of ideas for the sequel to Salvation, including having Robert Patrick back for a role in it and everything looked great.

Now, not so much. Will there even be a sequel to Salvation? If there is, will the same creative team be there to make it? Will they pay Christian Bale a ton of money to do it and will McG again direct?

Continue to Page 2 for more on this and and where the sequel will take place…

Terminator Salvation was one of my most anticipated films of the year. Unfortunately, it did not live up to the hype for myself and many other Terminator fans, let alone the critics who tore it apart in the plethora of negative reviews found online and in print everywhere.

While the movie is still just opening in many of the foreign markets, its financial performance in theaters is a clear disappointment for director McG and the studio. I wonder if they’re still considering forming a trilogy out of it…

The movie opened on May 21st in North America to bring in around $42.5 million, significantly less than its monthly competitors in Star Trek, Up and X-Men Origins: Wolverine. A big factor in this is the fact that it opened on the date as Night of the Museum 2 which devoured the family segment of the moviegoers that weekend and ended up being the number one film, beating out the fourth Terminator installment.

That being said, I’m sure the awful reviews of the film didn’t help it much either. On Rotten Tomatoes, Terminator Salvation is sitting at 34% and as of today, Terminator Salvation has only brought in around $120 million worldwide while its production budget was $200. It’ll still bring in more with its foreign releases but its near done in its key markets with new films opening every week taking the viewers away.

For instance, this weekend we had Up and Drag Me to Hell open to fantastic reviews and positive fan reception and next weekend we have a pair of new comedies, so I can’t see many people going to see T4 now with all the other options and Star Trek still traveling at warp speed.

Is the moral of the story that Terminator needs Arnold Schwarzenegger as the lead? Many fans thought that leading up to Salvation and it seems the Studio now thinks that too with their most recent act of desperation to bring in more fans to see the flick. The latest TV spot for the movie reveals one of the surprise treats of the movie that wasn’t really a big surprise for those following updates for the movie online. That surprise is a cameo by Arnold, digitally added to the classic T-800 unit for a short scene in the film.

I guess its no longer a spoiler anymore since it is in the TV commercials – Check it out for yourself:

Don’t be fooled by this – What you see in the trailer is pretty much all the screen time he gets in the movie.

It’s too bad this film wasn’t better. It looked polished and finished unlike Wolverine but there was so little to it and none of the interesting plots were explored. Instead, a bunch of set pieces and action sequences were just thrown together with big special effects and references here and there to try and tie it in with the prior films.

If there’s another one, I hope we get a big improvement.

Can Christian Bale truly sell a movie on his own like Arnold could? What do you think of the TV spot showing off Arnold and the idea of another Terminator movie?

As we near the release of the highly anticipated Terminator Salvation, troubled MGM Studios is hoping to get into the Terminator game by positioning itself to take over the distribution of Terminator 5, part two in the planned new trilogy. Yep, shock waves are being felt around Hollywood, since Warner Bros. and Sony are distributing next week’s Terminator Film.

Terminator Salvation is opening in a week (May 21, 2009), and Warner Bros. is distributing the film domestically (much like it did with the under-rated Terminator 3: Rise of the Machines), while the international release is being handled by Sony. Halcyon, the production company behind the movie, is planning on creating a new trilogy starting with Salvation and director McG is already talking about potential T5 plot lines. So it’s a surprise that there may be a battle for the distribution rights.

A little history between MGM and the Terminator franchise: Orion Pictures owned the rights to the first film, then they went bankrupt and MGM picked up the rights (for DVD, etc.). Before that, production companies Carolco and TriStar Pictures produced and released the legendary sequel Terminator 2: Judgment Day. Then Cutthroat Island sunk Carolco, and producers Andrew G. Vajna and Mario Kassar had to fight to get the rights to make Terminator 3 with their new company, C2 Pictures. The company, along with Halcyon, also produce the Fox TV series The Sarah Connor Chronicles, which began airing episodes in early 2008.

Convoluted I know, but that’s how things sometimes work in Hollywood. When a production company goes bankrupt, the rights get bought up and sometimes split up, too.

After Terminator 3 came out in the summer of 2003, director Jonathan Mostow and writers John Brancato and Michael Ferris were developing a fourth film with MGM Studios interested in distributing the film. But with Arnold Schwarzenegger now the governator, and apparent infighting in C2 Pictures, Halcyon took over the rights (Vajna and Kassar remain as producers) and MGM got cold feet and backed out of distribution, following a lawsuit between them and Halcyon over the distribution (again convoluted, but that’s the story). Enter Warner Bros., Sony, director McG, star Christian Bale, and the rest is history.

The deal for Halcyon was that MGM Studios would get 30 days to approve whether or not it would help produce and distribute a Terminator 5 (based on the first draft of the script), which was the same deal they had on the fourth film. Now that Terminator Salvation is a red hot film (especially since Bale is a big star thanks to The Dark Knight), MGM understandably wants back in the Terminator business.

But there’s another problem: MGM Studios is in financial trouble. It’s paying $250 million in interest on loans just in 2010, and they have to pay off that debt by 2012 to the tune of a jaw-dropping $3.7 billion. Add to that, the troubled economy and how it’s affecting all studios, and you can quickly understand both why MGM wants Terminator 5 and why it may not be able to afford it.

It could be about a year before Halcyon presents MGM with the first draft of Terminator 5 and then put a high price tag on the production which could force MGM to pass after their allotted 30 day period. I’m betting that Warner Bros. and Sony will then get the next crack at it and we’ll see T5 in 2011 or 2012. Other studios are interested, but I think things will get resolved by then. We’ll keep you up-to-date on Terminator 5 as it unfolds, and as Terminator Salvation may break some box office records.

We’re now less than a month away from the release of Terminator Salvation, the latest installment in one of the most successful sci-fi franchises of all time. Fans are gearing themselves up for an explosive time at the theater, expecting plenty of bang for their buck, and I’m sure the final product won’t let them down.

The finishing touches are just being put onto Terminator Salvation right about now and yet director McG is already looking ahead to the inevitable sequel. I don’t think it’s too much of a spoiler to say that there most likely will be a sequel – with the amount of money Salvation is sure to make (can you really see it flopping?) I can’t see there not being one. However, with a sequel in mind, what does McG see it involving? Well, he’s let his thoughts on that very subject be known.

[WARNING: the following could be considered SPOILERIFIC since it hints at how Salvation may end]:

“I strongly suspect the next movie is going to take place in a [pre-Judgment Day] 2011… John Connor is going to travel back in time and he’s going to have to galvanize the [sic] militaries of the world for an impending Skynet invasion. They’ve figured out time travel to the degree where they can send more than one naked entity. So you’re going to have hunter killers and transports and harvesters and everything arriving in our time and Connor fighting back with conventional military warfare, which I think is going to be f***ing awesome. I also think he’s going to meet a scientist that’s going to look a lot like present-day Robert Patrick [who famously played the T-1000 in Terminator 2], talking about stem-cell research and how we can all live as idealized, younger versions of ourselves.”

This comes from a conversation between McG and director of the first two Terminator flicks, James Cameron, as they met to discuss the fourth in the franchise.

Wow, what I wouldn’t have given to have gotten in on that dialogue!…

McG is a director who I think gets more of a bad rap than he deserves. Sure, he directed Charlie’s Angels: Full Throttle, but he’s not directed nearly enough films to label him the atrocious director that some have been so quick to call him in the past (for example, the first Charlie’s Angels was a lot of fun… c’mon, just admit it…). However, I may just be willing to lend my ear to those many avid Mcg-naysayers when he says he wants time-travel to be a plot-point of T5.

Why? Haven’t we been there and done that? All three of the first movies involved people (well… robots…) getting sent back in time to complete a mission, so I really don’t see the need for doing pretty much the same thing again. We have been teased with the idea of the actual war between man and machine for decades now, and when we finally get Salvation which (hopefully) showcases that in all it’s glory, they’re just going to revert back to more of what we’ve seen before with the fifth movie?

Seems like a poor idea to me…

When it comes down to it, I trust McG with Terminator. From all of the many, many things we’ve seen so far (such as trailers, posters, images, info and so forth) it really does look like a heck of a lot of fun at the very least, and perhaps it will even be at the same level as the first or second movie (I don’t know if it will quite make that cut, but you never know…). It looks like he’s giving us the all-out war-centric Terminator movie we’ve been yearning for, and so I’m willing to give him the benefit of the doubt when it comes to his time-traveling plans for the next movie.

I just hope he can completely eradicate that doubt when the time comes…

So what is your opinion about a Terminator movie possibly involving time-travel again? Should they do it because it’s in tune with what we’ve seen with the first three? Or should they now set it exclusively in the future?

For all of what was said by McG, including his thoughts on the franchise up until this point, you can go to FilmJournal.

Terminator Salvation is set to open on May 21st in the US, and June 3rd in the UK this year.

MTV had the opportunity to speak with Terminator Salvation director, McG, about the new ending of the film and the possibility of a sequel (or two).

The conclusion of this fourth installment in the Terminator franchise has been a long-running issue for the filmmakers and studio executives. It started when an early leak revealed the controversial big-twist ending of the movie which made the people behind the film very displeased. As a result, the ending was completely re-done to avoid rampant spoilers.

The new ending is reportedly structured to be wide-open and sets up a story arc that can be used for the second Terminator trilogy. While hoping for a successful opening of the movie come May 21st, McG had this to say about the franchise:

“If we have good fortune we have indeed planned out two more ‘Terminator’ pictures… There’s an arc of story [in the new sequels].”

“The ending is indeed elliptical… And it challenges the audience. It’s not a happy little bow of an ending at all. The ending is tough and requires reflection, and in some degrees it bifurcates the audience. You walk back to the car and one person thinks it means this, and the other person thinks it means that.”

He explains that the ending points to Terminator 5, a movie we can almost expect will be green-lit in a matter of months – Terminator Salvation will no doubt bring in big numbers at the box office next month.

As for what we know about the Terminator 5 story, McG had the idea for the plot of the fifth installment to include a character played by Robert Patrick (who portrayed the infamous T-1000 unit from Terminator 2) – He would be an older scientist who’s working on a cure for juvenile diabetes and his work leads into the creation of the T-1000 Terminator unit based on him.

McG talks with Patrick regularly and recently, Patrick revealed his interest in participating in another Terminator installment while displaying his love and respect for the franchise and what it’s meant for him in life and in his career.

It’s a fantastic way to keep tying the new movies into the old ones – the more of that the better! We already know Linda Hamilton will be narrating the film as Sarah Connor and there’s still a chance we may see Arnold Schwarzenegger in Terminator Salvation one way or another.

Not having seen Salvation, do you think there should be a full second trilogy in the Terminator franchise?

Terminator Salvation opens May 21, 2009 and I’ll be there.
